48-Hour Off-Market Home Buyer Challenge – Rules & Details

 

1. How the Challenge Works
The purpose of the 48-Hour Off-Market Home Buyer Challenge is to give you meaningful visibility into off-market home opportunities that align with the intent of what you’re looking for. The challenge is considered fulfilled once you are provided access to qualifying off-market home data showing 500 or more relevant potential home opportunities. This access may be provided on the confirmation (“Thank You”) page immediately after submission, via email, or both.

This challenge is designed to help home buyers and long-term investors identify opportunities; it is not intended to provide pre-negotiated investment deals or guaranteed profit margins for flips.

2. What Counts as a Qualifying Opportunity
A qualifying opportunity is a residential property that is in or near the location you selected and meets or exceeds the minimum criteria you select (bedrooms, bathrooms, and square footage) and shows indicators that the homeowner may be open to selling off-market. These properties represent potential opportunities, not guarantees of availability or seller intent.

3. Service Area

Criteria must fall within regions served by The Simone Team.  We do assist clients all throughout the Bay Area, but the primary area for this 48hr Challenge is: Santa Clara County and Fremont.  We regularly help clients in nearby Bay Area counties, so feel free to ask about your specific needs.

4. About the Data You See After Submitting
Any lists or maps shown on the confirmation (“Thank You”) page are real off-market home data generated for other recent challenge participants. This information is substantially similar in format, scope, and value to the custom list we are generating for you and is provided so you can explore examples immediately while your personalized list is being prepared.

5. The 48-Hour Timing

The timer does not begin upon form submission.  It begins only after you are redirected to our confirmation page (immediately upon form submission) and we review and approve your criteria (usually within a few minutes of receipt of your form).  Once approved, you will receive a confirmation email stating that your 48-hour clock has officially begun.  Most participants receive their report much faster than 48 hours, often within 2–8 hours. But we guarantee delivery within 48 hours.

6. Email Delivery Notice
Your custom list is delivered via email. Because email providers may filter or block messages, you are responsible for checking spam or junk folders and adding us as a safe sender. If you do not receive your email within 12 hours, please contact us so we can ensure successful delivery. Access to qualifying data satisfies the challenge regardless of email visibility…and we are always happy to assist if delivery issues occur if you let us know.

7. Off-Market Definition
“Off-market” refers to properties not actively marketed for sale at the time they are identified. Some (usually very few) properties may later appear on the open market and still qualify as off-market opportunities for the purposes of this challenge.

8. What the Challenge Does Not Guarantee
The challenge does not guarantee that any homeowner will sell, respond, or accept an offer, nor does it guarantee pricing, terms, or transaction outcomes. The list represents an advantageous starting point for identifying and creating off-market opportunities.

9. Eligibility & Fair Use
We reserve the right to review, approve, or decline submissions. Duplicate submissions, inaccurate information, or attempts to abuse the challenge may be disqualified.  Only one submission per household is allowed in this challenge. For those who later decide to become buyer clients of ours, we will happily perform multiple such 500+ off-market home searches in an attempt to find you your dream home.

10. City/Area Definitions

Since San Jose is such a large city and has many distinct neighborhoods/areas, our form submission allows you to select specific neighborhoods within San Jose to give you much better results. Some of those neighborhoods share some of the same zip codes and/or are overlapping other areas of San Jose.  For our actual buyer clients, we can identify exactly what specific areas, zip codes, neighborhoods, etc. with pinpoint accuracy, and locate these off-market opportunities.  For the purposes of this Challenge, we have the right to deliver properties that potentially overlap into other San Jose areas and all such properties will count towards our 500 property deliverable. 

11. Our Guarantee
If access to qualifying off-market home data as described above is not provided within 48 hours, we will pay you $1,000. Access provided on the submission confirmation page and/or the custom 500+ list via email satisfies the terms of the challenge, regardless of whether the participant chooses to review the information.

12. Contact & Communication
By participating, you consent to receive emails, phone calls, and text messages related to your 48-Hour Challenge submission, off-market home opportunities, and our real estate services.

Message and data rates may apply. Consent is not a condition of purchasing any services. You may opt out of marketing communications at any time by following the instructions provided in our messages or by contacting us directly.

13. Delivery & Cooperation Requirement

We will deliver your custom list of 500+ off-market home opportunities via email. If you provide a mobile number and opt in to text updates, we may also notify you by text when your list has been sent or provide an alternate delivery method.

Our expectation is that delivery will be completed through these methods without requiring a phone conversation. However, in the event you do not see your list via email or text, you agree to notify us within 18 hours of submission so we can arrange an alternate delivery method and ensure you receive your results.

This challenge requires reasonable cooperation to confirm delivery. Failure to notify us of delivery issues within this time frame will be considered fulfillment of the challenge requirements.

14. Privacy Protection

Full street numbers, owner names, occupancy details, and contact information are not provided. We have all this information. If you are working with us to purchase a home, we will obviously give you the full street address. We will identify which have owners considering selling. Then you and I will visit the properties together to see if you are interested in buying any of them off-market (often at a discount).

15. Limitation of Liability

Maximum liability for this challenge is $1,000.
No additional damages, claims, or obligations apply.

16. No Contract or Agency Relationship

Participation does not create a client relationship.
You are not required to use The Simone Team for buyer representation.
If you do decide you want to work with us to buy or sell a home, a separate buyer-agent agreement will be established at your discretion.
